Terms of Service

These Terms of Service (“Terms”) govern your access to and use of blueoceanapplications.com (the “Site”) and any related services offered by Blue Ocean Applications (“we,” “us,” “our”). By accessing or using the Site, you agree to these Terms.

1) Use of the Site

You must be at least 13 years old (or the age required by your jurisdiction) to use the Site.
You agree not to misuse the Site, including attempting to interfere with its normal operation or security.
We may modify or discontinue the Site (in whole or part) at any time.

2) Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
You must provide accurate information and promptly update any changes.

3) Purchases & Subscriptions

Purchases and subscriptions (including in-app purchases) may be processed by third parties such as Stripe, Apple, Google, and RevenueCat. Their terms and policies apply in addition to these Terms.

4) Intellectual Property

The Site, including content, logos, designs, and software, is owned by Blue Ocean Applications or our licensors and protected by intellectual property laws. You may not copy, distribute, or create derivative works without prior written permission.

5) User Content

If the Site or our apps allow you to submit content (e.g., feedback, reflections), you grant us a non-exclusive, worldwide, royalty-free license to use, store, reproduce, and display that content solely to operate and improve the services. You represent that you have all rights necessary for such submissions.

6) Acceptable Use

No unlawful, infringing, or harmful activity.
No attempts to reverse engineer, probe, or overload our infrastructure.
No automated scraping except as permitted by robots.txt.

7) AI Features & Guidance

Our services may include AI-generated text and images. AI outputs are provided for informational and wellness purposes only and are not medical or professional advice. Do not rely on AI outputs for diagnosis, treatment, or emergency situations.

8) Disclaimers

The Site is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

9) Limitation of Liability

To the maximum extent permitted by law, Blue Ocean Applications and its affiliates will not be liable for any indirect, incidental, consequential, special, or punitive damages, or any loss of profits or revenues, arising from or related to your use of the Site, whether based in contract, tort, or otherwise.

10) Indemnity

You agree to indemnify and hold harmless Blue Ocean Applications from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or misuse of the Site.

11) Governing Law & Dispute Resolution

These Terms are governed by the laws of British Columbia, Canada. Before filing for arbitration, the parties will attempt to resolve disputes in good faith for at least 30 days. If unresolved, disputes will be settled by binding arbitration seated in British Columbia, Canada, on an individual basis (no class actions). You and we each waive the right to a jury trial.

12) Termination

We may suspend or terminate your access to the Site at any time if you violate these Terms or if we discontinue the Site.

13) Changes to the Terms

We may update these Terms from time to time. If we make material changes, we will post the new Terms on this page with an updated effective date.
